About these terms

This website is operated by Capricos, a design and marketing studio run by a sole trader in the United Kingdom. Using the site means accepting what's below. It's short on purpose.

These terms cover the website. They are not the terms of any work Capricos does for you. Paid work is governed by a separate written proposal and agreement, which is where scope, price, timescales, ownership of what's built, and what happens if either side wants out are all set down properly. Nothing on this page overrides that agreement.

Using the site

You may read this site, and use the forms on it to make a genuine enquiry. You may not:

  • use it for anything unlawful, or to send anything abusive, misleading or deliberately harmful;
  • attempt to gain unauthorised access to it or anything connected to it;
  • scrape it at a scale that interferes with it working, or use automated means to submit the forms;
  • copy its design, code, text or images and pass them off as your own.

Who owns what's on it

The design, code, written content, photography and the Capricos name and mark are owned by Capricos or used with permission, and are protected by copyright and trade mark law. You may not reuse them commercially without written permission.

The portfolio shows work produced by Capricos for named clients. Those brands, logos and marks belong to those clients and appear here as a record of work done, not as any claim over them.

What the site claims

The information here is offered in good faith and is accurate as far as we know at the time of writing. Figures on the site — years of experience, number of systems built, the public review score — are real, and can be substantiated on request.

Nothing on this site is a binding offer, a quotation, or professional advice for your particular situation. Prices are indicative until they're in a written proposal. A guide price of "$20,000 and up" describes the shape of the work; the number in your proposal is the number that counts.

Enquiries and the forms

Sending an enquiry doesn't create a contract, and doesn't oblige Capricos to take the work on. We reply to genuine enquiries, but reserve the right to decline any project.

What you send us through a form is handled as described in the Privacy Policy. Don't send confidential or sensitive information through a web form — if the conversation needs to get into that territory, we'll agree a sensible way to do it.

Availability

We try to keep the site up and correct, but it's provided "as is". We don't guarantee it will be uninterrupted, error-free, or free from anything harmful, and we may change or withdraw any part of it without notice.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. That's not boilerplate — those limits exist and we're not trying to get around them.

Beyond that, and to the extent the law allows: Capricos is not liable for indirect or consequential loss, loss of profit, loss of business or loss of data arising from your use of this website. Liability for any paid work is dealt with in the agreement for that work, not here.

If you're a consumer rather than a business, you keep all your statutory rights, and nothing here affects them.

Links to other sites

This site links out to a small number of third-party sites, including Trustpilot and Instagram. Those sites are not under our control, and we're not responsible for their content or their privacy practices. Their terms apply when you're on them.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.

If you're a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory consumer law of the country you live in, and may be able to bring proceedings there.
